Commercial transactions, contracts and litigation

Collections

Machaba Inc. can assist with the collection of outstanding debts, taxes , rates and levies as well as any other amounts that may be due arising from whatever cause recognised in law.

Road Accident Fund (RAF) claims and motor vehicle accident (MVA) claims

After a traumatic event like a road accident, the last thing our clients want to deal with is stressful paperwork. If they have been involved in a motor vehicle accident, they have two claim options: damages for any personal injuries and damages to their property.

By law, we handle these claims handled differently.

For any motor vehicle damage, we act on our clients’ behalf to claim from the driver or owner of the vehicle who caused the accident.

However, if our clients are injured or a member of their family has died as a result of the accident, we can claim compensation on their behalf from the Road Accident Fund (RAF).

This fund pays compensation owed to the victim of a road accident on behalf of the negligent driver. The RAF itself is funded by the fuel levy, a tax that is included in the price of diesel or fuel, which all vehicle owners buy.

On your behalf, we can claim for:

• Bodily injuries and any medical expenses, pain and suffering that result from these.
• Loss of earnings caused by the accident.
• Loss of the earnings of the family breadwinner who has either died or become too injured to work.

Property transactions

When it comes to buying and selling property, you are in safe hands. Machaba Inc. offers all relevant services relating to property transfers and bond registrations with the Deeds Office. In addition to property transactions and servitude, we do title deeds audits especially for old houses situated in different locations around the country.

• Carrying out and checking pre-contract searches to establish whether the property is affected by local authority proposals, leases, covenants, mortgages, land tax, susceptibility to flooding or subsidence, or liability for unsound building structures and repairs

• Receiving and checking mortgage instructions from lenders and undertaking specific tasks required
• Preparing transfer and mortgage deeds

Tax, due diligence and forensic investigation services

Machaba Inc. assists companies as well as individuals with tax compliance, negotiations with the Receiver (SARS) as well general aspects of tax law. Part of our services include doing due diligence to establish issues such as the real corporate status of companies, shareholders and their shareholding, fronting etc.
